Premises liability at shopping centers
In California (Civil Code § 1714), and similarly in most states, property owners and those who control property must use reasonable care to keep it safe. In a mall, several parties may share responsibility: the property owner, the management company, a tenant store, a security contractor, or an escalator maintenance company.
To recover, an injured person generally must show a dangerous condition existed, the responsible party knew or should have known about it, they failed to fix it or warn, and that failure caused the injury. For assaults, the question is often whether prior similar incidents made the harm foreseeable.
